Overview
We are conducting a review of the PEMM Act, to determine its effectiveness on the operation of the market and its benefit to consumers.
You can now provide feedback and share your ideas. Your feedback will help us to assess the effectiveness of these provisions and provide a final report to Government by June 2025. The terms of reference require us to assess the effectiveness with reference to Section 15 (Part 4) of the PEMM Act. These include the impacts on electricity market performance, including market efficiency, equity, reliability, affordability, emission reduction and investment outcomes.
Consultation
We undertook initial consultation through one-on-one discussions with stakeholders who registered their interest in participating in our process.

What we heard
Submissions on our consultation paper closed on 31 January 2025. Thank you to those who provided submissions.

Findings of the review
On August 1, 2025, the Minister for Climate Change and Energy released the report.
The review found that, on balance, the PEMM provisions are likely to have been effective in having a net positive impact on constraining behaviour of market participants and protecting consumers.
The review identified opportunities to strengthen the PEMM Act. In addition, the review identified opportunities to better leverage the expertise of market bodies in relation to the PEMM provisions.
Next steps
The department will consult on potential amendments to the PEMM provisions later this year.
