What personal information will be collected

Please take the time to read the privacy information on this page. It will provide you with information about your privacy and how we will handle your information.

If you choose to participate in this Basin First Nations enduring water holding arrangements consultation process (the consultation process), we will collect, use and disclose personal information (including sensitive information) about you.

Personal information means information or an opinion about an individual, or an individual who is reasonably identifiable, whether or not it is true or recorded in material form.

Sensitive information is a subset of personal information and attracts a higher level of privacy protection. Sensitive information includes information or opinions about an individual's racial or ethnic origin (e.g. indigeneity), a political opinion or association, religious beliefs or affiliations, trade or professional associations and memberships, a criminal record and health information.

By submitting a response to this consultation process, you consent to the department collecting your personal information (including sensitive information). This may include:

  • your name, email address and telephone number (optional);

  • information about your First Nations identity, including which Nation you belong to;

  • your opinions about the design of proposed Basin First Nations enduring water holding arrangements; and

  • any other personal information (including sensitive information) provided by you in your response to the consultation process.

It is assumed that participants will not be providing personal information about another person. However, if you are making a submission on behalf of another person, or your submission contains someone else’s personal information, you must have their consent.

We are bound by the Australian Privacy Principles in Schedule 1 of the Privacy Act 1988 (Cth). The Privacy Act regulates how we may collect, use, disclose and store personal information. We also hold personal information in accordance with the Archives Act 1983 (Cth).

The department seeks to maximise First Nations participation in its work and decision-making to the extent possible given the legal context or nature of an engagement. The consultation process is supported by the department’s ‘First Nations Engagement: the principles of Free, Prior and Informed Consent’.

We use technology by Converlens Pty Ltd to provide this consultation service and website. Our contractual arrangements require Converlens to comply with the Privacy Act and store data securely in Australia.

How we will use and disclose your personal information

We will use any personal information (including sensitive information) provided in your submission to:

  • assist the department with co-design the Murray–Darling Basin First Nations enduring water holding arrangements

  • contact you about your submission, including for further information and feedback

  • inform you about the outcomes of this consultation process and/or other matters that we consider may be relevant to you;

  • other related activities.

Your personal information (including sensitive information) provided in your submission may be disclosed to department staff, the Minister and their staff, for the purpose of assisting the design the Murray–Darling Basin First Nations enduring water holding arrangements.

Your personal information (including sensitive information) will be de-identified before it is shared with third-party suppliers engaged by the department to support this work.

The de-identification process will ensure that your name, address, email and telephone number will not be provided to authorised third parties. However, de-identified feedback and views about the design of Basin First Nations enduring water holding may be shared with authorised third parties and used to inform findings reports.

We will not disclose your personal information (including sensitive information) other than in the above circumstances, unless required by law.
