Personal information collection
Our privacy collection statement contains standard text approved by the legal branches of the department’s Chief Counsel Division. It outlines how you will meet the Australian Privacy Principles in Schedule 1 of the Privacy Act 1988 and covers:
what personal information you are collecting
who it will be disclosed to
why it will be disclosed.
You will need to customise this text to suit your consultation or survey. If you will collect or deal with personal information in ways this statement doesn’t cover, you will need to include these uses. You may also need to specify this up front and/or when you collect this information. If participants provide feedback outside of the Have Your Say platform, you will need to provide them with a copy of the statement to review and ask them if they agree with what the statement outlines.

How will you collect and deal with personal information?
We will disclose your personal information provided in your response to the expression of interest to departmental staff. The department may potentially disclose personal information to staff from other government departments, Ministers and their staff, external organisations and service providers, which may include:
parliamentary committees
employees and advisers engaged by the Commonwealth
Australian state or territory government agencies, and
Commonwealth departments, agencies, bodies, enterprises, authorities, ministers and any legal, policy or other department accountability requirements.
This disclosure would be for the purpose of:
informing the contents of responses to the expression of interest;
consulting with Ministers and/or any relevant advisory committees;
activities related to the above.
We may also disclose your personal information where authorise and/or required to by law (including in accordance with the Freedom of Information Act 1982 (Cth)).
Privacy notice
The Department of Climate Change, Energy, the Environment and Water (the department/ we) is seeking expressions of interest from experienced and skilled individuals or entities to provide reporting, consultation, and mediation services under the Aboriginal Torres Strait Islander Heritage Protection Act 1984 (the ATSIHP Act).

We are bound by the Australian Privacy Principles in Schedule 1 of the Privacy Act 1988 (Cth) (the Privacy Act). The Privacy Act regulates how we may collect, use, disclose and store personal information. We also hold personal information in accordance with the Archives Act 1983 (Cth).
We use technology by Converlens Pty Ltd to provide this consultation service and website. Our contractual arrangements require Converlens to comply with the Privacy Act and store data securely in Australia.
What personal information will be collected
Personal information means information or an opinion about an individual, or an individual who is reasonably identifiable, whether or not it is true or recorded in material form.
Sensitive information is a subset of personal information and attracts a higher level of privacy protection. Sensitive information includes information or opinions about an individual's racial or ethnic origin (e.g. indigeneity), a political opinion or association, religious beliefs or affiliations, trade or professional associations and memberships, a criminal record and health information.
By submitting a response to this expression of interest, you consent to the department collecting your personal information (which also includes sensitive information) provided in your response to the expression of interest. This may include:
your name, address, email address and telephone number
information about your whether you are Indigenous status or cultural identify (e.g. indigeneity);
the status of your organisation as being a First Nations organisation;
trade or professional associations and memberships;
any other personal information (including sensitive information) provided by you in your response to the expression of interest.
How we will use and disclose your personal information
The department will use any personal information provided in your response to the expression of interest to:
assess the outcomes and effectiveness of the expression of interest;
contact you about your response to the expression of interest, including for further information or feedback;
inform you about the outcomes of the expression of interest and/or other matters that we consider may be relevant to you.
The personal information provided in your response to the expression of interest will be disclosed to staff within the department, for the purpose of:
creating a list of service providers;
approaching service providers to fill roles required under the ATSIHP Act;
inform you about the outcomes of the expression of interest and/or other matters that we consider may be relevant to you; and
keep you informed about future expression of interest processes and/or other opportunities that we consider may interest you.

In addition to the above, the personal information provided in your response to the expression of interest will be disclosed to departmental staff and potentially staff from other government departments, Ministers and their staff, external organisations and service providers, which may include:
